Durante sessão de julgamento realizada em 14.09.2016, o Plenário do CADE aprovou proposta de TCC referente ao cartel em licitações públicas para a compra de medicamentos por diversos estados da federação. A relevância deste caso se deve ao Voto do Conselheiro João Paulo, o qual realizou análise da vantagem auferida pela empresa durante os anos de funcionamento do cartel, de forma a verificar se o valor proposto era proporcional e adequado. Em sessões passadas o Conselheiro vinha criticando os valores das contribuições propostas, afirmando que não guardavam relação com os danos causados pelo agente no mercado, sendo inferiores à vantagem auferida. O Conselheiro apresentou sua metodologia no voto, registrando que “considerei duas extrapolações: (i) calculei a média mensal de faturamento entre maio de 2007 a janeiro de 2012 e somei o correspondente [ACESSO RESTRITO]; em seguida, (ii) dobrei o valor encontrado como forma de abarcar licitações referentes a outros Estados, cujas informações não foram apresentadas pela Requerente”, concluindo que o valor guardava proporcionalidade com a vantagem auferida pela parte.
14/10/2016During the trial session held on 09.14.2016, CADE’s Tribunal approved a CDA proposed in a cartel investigation concerning public tenders for the purchase of medicine by several states. The relevance of this case stems from an opinion issued by Commissioner João Paulo, who conducted an analysis of the benefits received by the company during the years in which the cartel was in place; in order to verify whether the proposed amount of the pecuniary contribution was proportional and appropriate. During previous sessions, the Commissioner criticized the amounts that were being proposed for contributions, stating that these were not corresponding to the damages caused by the agent in the market and were lower than the benefits received. The Commissioner presented his methodology in the opinion, noting that “two extrapolations were considered: (i) calculation of the average monthly revenue from May of 2007 to January of 2012 and added to the corresponding [RESTRICTED ACCESS]; then (ii) I doubled the value found in order to encompass bids from other States, whose information was not presented by the Applicant “, concluding that the amount was found to be proportional to the advantage obtained by the party.
