CADE SUGERE ARQUIVAMENTO POR FALTA DE PROVAS

No dia 07 de outubro de 2015, a Superintendência-Geral do Cade emitiu parecer sugerindo o arquivamento em relação a todos os Representados no processo administrativo que investiga a existência de suposto cartel no mercado de granalhas de aço para corte de mármores e granitos. O processo, que se originou de uma denúncia, apurava a suposta divisão de clientes, fixação de preços e de reajustes no Estado de São Paulo. A esperada decisão, proferida após oito anos da instauração do processo administrativo, entendeu que as provas constantes nos autos eram insuficientes para que as condutas denunciadas fossem confirmadas. A perícia realizada nas fitas K-7 entregues pelo denunciante no início das investigações verificou inconsistências nas mesmas, vez que foram entregues 7 fitas K-7 como evidência das alegações do denunciante, mas foram examinadas apenas 5, que apresentaram conteúdo distinto e marcas de alteração. Tais incongruências levaram a SG a entender que elas não poderiam mais ser utilizadas como principal elemento probatório. Além disso, os outros elementos de prova que a SG possuía se mostraram tão ou mais frágeis do que as gravações. Os documentos colhidos na busca e apreensão não demonstravam qualquer acerto ou existência de reunião entre os concorrentes, sendo apenas estudos ou documentos estratégicos normais em um mercado competitivo. Ademais, a oitiva de testemunhas também não trouxe qualquer elemento válido, incluindo o depoimento do denunciante, o qual foi vago e não apresentou informações contundentes. De forma acertada, após quase 10 anos de investigação, a SG reconheceu todos esses fatos e opinou pelo arquivamento do processo administrativo. Entretanto, este não é o fim do caso, que foi enviado ao Tribunal do Cade; este poderá proceder a instrução complementar ou simplesmente por o processo em pauta de julgamento para que o arquivamento seja acolhido ou não.

04/11/2015On October 7th, 2015, Cade’s General-Superintendence (SG) issued a legal opinion suggesting the closing of the investigation, in regards to all parties of the procedure, of an alleged cartel in the market of steel-grit for the cutting of marble and granite. The proceeding, which originated from a complaint, probed alleged client division, and the fixing of prices and price readjustments in the state of São Paulo. The awaited decision, handed down 8 years after the commencement of the proceeding, stated that the evidence available in the files was insufficient to confirm the alleged practices. The forensic analyses made in the tapes delivered by the complainant in the beginning of the investigations showed inconsistencies, since he had delivered 7 tapes as evidence but only 5 were analyzed, which had different content than expected and alteration marks. Those inconsistencies led the SG to conclude that they could not be used as main evidence. Besides that, the other supporting evidence available in the files was as fragile as the analyzed records. Documents collected during the search and seizure proceedings did not prove the existence of any meeting between the competitors, presenting only studies or strategic documents that are normal in a competitive environment. Furthermore, witness testimony did not bring any other valid evidence, including the complainant’s testimony, which was vague and with inconclusive information. Correctly, after almost 10 years of investigation, SG recognized all these facts and suggested the closing of the administrative proceeding. However, this not the end of the case; which was sent to Cade’s Tribunal, who can carry out a complementary investigation or simply put the case up for trial so that the decision to close the case can be accepted or not.
